These terms govern your use of this website. The Lightwork product is a separate thing: it is offered only under a written agreement, and it is in private alpha. Nothing on this site is an offer, a warranty, or a licence.

These terms of use (the “Terms”) apply to your use of this website at daybreakailabs.com (the “Site”), operated by Daybreak Labs (“Daybreak Labs”, “we”, “us”). By using the Site you agree to these Terms. If you do not agree, do not use the Site.
These Terms cover the Site only. They do not cover the Lightwork product, which is provided separately (see section 5).
You may view the Site and contact us through the links it provides. You agree not to misuse the Site: no attempting to breach or probe its security, no automated scraping or bulk downloading beyond ordinary browsing and search-engine indexing, no interfering with its operation, and no using it to send unsolicited or unlawful communications. We may suspend access that we reasonably believe is misusing the Site.
The content on the Site is provided for general information about Daybreak Labs and Lightwork. It is not an offer, a proposal, a price quote, or a commitment, and it does not create a contract. Any figures, capabilities, roadmaps, or status descriptions on the Site are current thinking and may change without notice.
The Site is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the fullest extent permitted by law.
The Site and its contents — including the text, layout, design, the Daybreak Labs name and marks, the Lightwork name, and the visual identity — belong to Daybreak Labs or its licensors and are protected by intellectual-property laws. Lightwork is a product of Daybreak Labs. You may not copy, reproduce, republish, or create derivative works from the Site’s content except as permitted by ordinary browser caching and fair use, or with our written permission. These Terms grant you no licence to any Daybreak Labs or Lightwork intellectual property.
Lightwork is offered only to organizations we work with directly, under a separate written agreement that sets out the licence, service levels, security terms, fees, and everything else that governs the product. During private alpha, access is by invitation and is not generally available. Nothing on the Site, and nothing in these Terms, grants you any right to access or use the product, and a demonstration or conversation does not create one. If we enter a written agreement with you for the product, that agreement — not these Terms — governs your use of it.
The Site is hosted on Cloudflare and uses Cloudflare Web Analytics, which is cookieless (see our Privacy & cookies page). Links to third-party sites or services are provided for convenience; we are not responsible for their content or practices. Email you send us through the Site’s links is handled as described in the Privacy page.
To the fullest extent permitted by law, Daybreak Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of, or inability to use, the Site — whether based in contract, tort, or any other theory, and even if we have been advised of the possibility. Some jurisdictions do not allow certain of these limitations, in which case they apply to the extent permitted.
We may update these Terms from time to time. The version posted here, with its “last updated” date, is the current one. Your continued use of the Site after a change means you accept the updated Terms.
These Terms are governed by the laws of the United States and of the state in which Daybreak Labs is established, without regard to conflict-of-laws rules, and the courts located there have exclusive jurisdiction over any dispute relating to the Site or these Terms.
